1. Acceptance of Terms

By accessing and using CubanGuesser ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Sade Studio (sadestudio.design).

2. Description of Service

CubanGuesser is a free-to-play geography guessing game focused on Cuba. Players guess the municipality of Cuba based on photos. The game includes free modes (Personas, Lugares) and a paid feature (Cupido profiles).

3. User Accounts

• You may sign in using Google Authentication to save progress and appear on leaderboards.
• You are responsible for maintaining the security of your account.
• You must be at least 13 years old to use the Service.
• You must be at least 18 years old to purchase Cupido profiles.

4. Cupido Profiles (Paid Feature)

• Price: $6.99 USD per profile submission.
• What you get: Your photo, name, bio, and social media links displayed to players during gameplay after your profile is approved by an admin.
• Approval: All Cupido profiles are subject to admin review. We reserve the right to reject any profile for any reason.
• Content Guidelines: Profiles must not contain nudity, sexually explicit content, offensive, illegal, hateful, or misleading content.
• Zero Tolerance Policy: Any submission containing nudity or sexual content will be immediately rejected and the user permanently banned from the platform. NO REFUNDS will be issued for banned accounts. This policy is strictly enforced.
• Duration: Approved profiles remain in the game indefinitely unless removed for policy violations.

5. Payments

• All payments are processed securely by Stripe.
• We do not store your payment card information.
• Prices are in USD and include all applicable fees.
• By making a purchase, you authorize us to charge your payment method.

6. Refund Policy

• Approved profiles: Non-refundable once published in the game.
• Rejected profiles: Eligible for a full refund. Contact us to request.
• Technical issues: If payment was processed but the profile was not saved, contact us for resolution.
• Refund requests must be made within 30 days of purchase.

7. User Content

• By submitting content (photos, rounds, Cupido profiles), you grant us a non-exclusive, worldwide license to display that content in the game.
• You represent that you have the right to submit any content you provide.
• You are solely responsible for the content you submit.
• We may remove any content at our discretion.

8. Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose
• Submit false, misleading, or offensive content
• Attempt to hack, exploit, or disrupt the Service
• Impersonate another person
• Use automated tools to interact with the Service
• Abuse the multiplayer system or manipulate leaderboards

9. Intellectual Property

The CubanGuesser game, including its design, code, and branding, is the property of Sade Studio. Municipality data is derived from open-source geographic datasets. Satellite imagery is provided by ESRI. Location photos are from Wikimedia Commons (Creative Commons licensed).

10. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access, accuracy of game data, or that the Service will meet your expectations.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms. You may stop using the Service at any time.

13. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms.

14. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of New Jersey, USA.
